Terms of Service

The short version

  • HitApply is a tool that drafts application documents and fills in job application forms. It is not a recruiter and can't promise you a job.
  • Everything HitApply writes or fills in is a draft. AI can be wrong, so you check it before you use it.
  • You are the applicant. Every application you send, and every consent, certification or answer on an employer's form, is your decision, including ones made by tools acting on your instructions.
  • HitApply never presses Submit. An AI assistant you connect is your agent, and you are responsible for what it does.
  • HitApply is a free beta, provided as-is. Keep your own copies of anything important.
  • You must be 18 or older. Saskatchewan law applies.

This summary is here to help you read what follows. It isn't the full agreement; the full text below governs.

1. Who we are and this agreement

HitApply is operated by John Mark Lecegues, an individual based in Saskatchewan, Canada (“HitApply”, “we”, “us”). These Terms of Service are an agreement between you and us. They cover the HitApply website, the HitApply browser extension, and HitApply's connections to AI assistants (together, the “Service”). Our Privacy Policy explains how we handle your information and is part of these Terms.

By creating an account, selecting “Agree and continue”, or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

You must be at least 18 years old to use HitApply. HitApply is currently an invite-only beta and is free to use. If we introduce paid plans, they will come with their own terms, which we will show you before you pay for anything.

We may update these Terms. When we make a material change, we will update the date at the top and ask you to agree to the new version. Until you do, the Service, including the extension and any connected AI assistant, is paused for your account.

2. What HitApply is, and isn't

HitApply helps you find job postings, drafts tailored résumés and cover letters from the information you give it, tracks your applications, and can fill in application forms in your browser.

HitApply is a software tool. It is not an employment agency, recruiter, career counsellor, or legal or immigration advisor, and nothing in the Service is professional advice. We don't control employers, job boards or applicant tracking systems (“ATS”), and we don't guarantee any interview, job offer, or other outcome, or that any job posting is accurate, current, or still open.

3. You are the applicant

Everything HitApply produces is a draft.Résumés, cover letters, suggested answers, match scores and filled-in form fields are generated with the help of AI and automation. They can contain mistakes, omissions, or statements that aren't true about you. You must review and correct every document and every field before you use or submit it.

You are the applicant, and every application is your decision.This includes every submission and every consent, attestation, certification, acknowledgement or answer given on an employer's or ATS form, for example:

  • agreeing to an employer's or ATS's terms or privacy policy, or creating an account with them;
  • equal-employment, demographic, disability or veteran self-identification answers;
  • authorizations for background checks, drug tests or reference checks;
  • certifications that the information you provided is true and complete.

This is true whether you give them yourself, through HitApply's autofill, or through any tool or agent acting on your instructions. You are responsible for making sure everything you submit is accurate and that you actually agree to anything you consent to.

HitApply never presses Submit on an application.

4. Autofill and AI assistants

The HitApply extension works only on pages you open, and fills in forms only when you start it. Before autofill ticks any consent or certification box for you, it asks for your permission, and you remain responsible for every box it ticks with that permission.

You can connect an AI assistant (such as ChatGPT or Claude) to your HitApply account. That assistant is youragent, not ours. It acts on your instructions and under its provider's own terms. Through HitApply it can read the HitApply data you allow it to and, if you grant write access, add and queue jobs, edit your documents and profiles, and mark applications as applied. It can't delete your data or submit an application through HitApply. If you set an assistant up to drive the extension or submit applications for you, it should do so only after you confirm, and you are responsible for everything it does, just as if you had done it yourself. You can disconnect an assistant at any time in Settings.

5. Job boards, employers and other sites

When you use HitApply on a job board, ATS or employer site, you must also follow that site's terms. Some sites restrict automated tools, and a site may limit or close your account there. That risk is yours.

HitApply is not affiliated with, endorsed by, or sponsored by any employer, job board or ATS. Their names and trademarks belong to them. We aren't responsible for their sites, their decisions, or how they handle the information you send them.

6. Acceptable use

You agree not to:

  • submit false or misleading information, or apply as anyone other than yourself;
  • use HitApply to send spam or bulk applications to jobs you don't genuinely want;
  • share your account, or let anyone else use it;
  • interfere with, overload, probe, scrape, copy or reverse-engineer the Service, or get around its limits or security;
  • use the Service for anything unlawful or to harm anyone.

7. Your content

You keep ownership of what you put into HitApply (your profile, résumé, answers and documents) and of the documents generated for you. You give us a limited licence to store, process and transmit that content only to run the Service for you, as described in our Privacy Policy.

You confirm that the content you provide is accurate, is yours, and that you have the right to use it.

8. AI providers and limits

HitApply sends your content to AI models through OpenRouter, which passes it to the model provider that serves the request. The Privacy Policyexplains this. AI output may be wrong, and we don't control the providers' models.

If we give you an AI key, it comes with a usage limit. We may change limits, models and features, or pause generation, at any time.

9. Beta, provided as-is

HitApply is a beta. Features may change or stop, and the Service may be unavailable, slow, or lose data. Keep your own copies of your résumé and anything else important.

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law:

  • we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost opportunities, lost income, or lost data;
  • in particular, we are not liable for: an employer's decision about you; a rejected, missed or incorrect application; errors in generated documents or filled-in fields; consents or answers given on your behalf with your permission; actions taken by an AI assistant you connected; or a third-party site restricting your account;
  • our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or CAD $100.

Some places don't allow certain limits on liability. Where that applies, these limits apply only as far as the law allows.

11. Your responsibility for claims

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from: content you provide; applications, consents and answers you submit or that are submitted on your instructions; your breach of these Terms or of a third-party site's terms; or the actions of any AI assistant or other tool you connect to HitApply.

12. Ending your use

You can stop using HitApply at any time, and ask us to delete your account by emailing privacy@hitapply.app.

We may suspend or close your account if you break these Terms, if needed to protect the Service or other people, or if we end the beta. Where reasonable, we'll tell you first. Sections that by their nature should survive (including sections 3, 4, 9, 10, 11 and 13) continue after your account ends.

13. Governing law

These Terms are governed by the laws of the Province of Saskatchewan and the federal laws of Canada that apply there. You and we agree to the jurisdiction of the courts of Saskatchewan, unless the law where you live gives you the right to bring a claim in your local courts.

14. General

These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. If we don't enforce a part right away, we haven't given up the right to enforce it later. You can't transfer your rights under these Terms. We may transfer ours to someone who takes over the Service, and they would remain bound by these Terms. Questions: privacy@hitapply.app.
